Amenia man gets 9 months in jail for DUI with child in car

GREAT BARRINGTON —Steven F. Jarvis, 49, of Amenia who was arrested earlier this month on his third drunken driving offense  with an 8-year-old boy and a woman  in the car vehicle  has been sentenced to nine months in jail.

Due to the seriousness of operating a motor vehicle while impaired with a child in the vehicle, MA  state law mandates a 90-day jail sentence in addition to any sentence imposed, according to a court official. The sentence cannot be concurrent.

Jarvis has two previous OUI convictions in New York. He was given credit for eight days served in jail.

Jarvis was stopped at about 3:06 p.m. Sept. 10 in Great Barrington after Officer Samuel G. Stolzer noticed his license plate number matched a bulletin issued about a vehicle that had been involved in a hit-and-run accident in Lee earlier in the day.

Stolzer gave him a series of sobriety tests and two breath tests: the first recorded a blood alcohol concentration of 0.11 percent; the second read 0.10. The legal limit in Massachusetts is 0.08.

Jarvis also admitted that he had an open OUI case in New York state, which restricts his driving to school or work.
