Two Charged with Drug Offenses in Wappinger
Both were arrested on 12/7/16 by the Sheriff’s Office School Resource Officer after an investigation revealed that the first defendant allegedly stole prescription medication from a friend the day before and gave it to the second defendant on 12/7/16. The theft of the medication occurred off school grounds, while the remainder of the incident occurred on school grounds. The charges for both are as follows:
First defendant
- Criminal possession of a controlled substance 5th degree – felony
- Criminal sale of a controlled substance 4th degree – felony
- Petit larceny – misd.
Second defendant
- Tampering with physical evidence – felony
- Criminal possession of a controlled substance 7th degree – misd.
The criminal sale charge was brought because under the law giving someone a controlled substance is considered a sale; regardless of whether or not money was exchanged (it was not in this case). In addition the evidence tampering charge was brought because the second defendant allegedly attempted to discard evidence during the investigation.
After being processed both were arraigned before the Town of Wappinger Court, after which the first was remanded to the Dutchess County Jail in lieu of $5,000 cash bail or $10,000 bond and the second was released on their own recognizance.
As with any criminal case, the charges described above are merely accusations and the defendants are presumed innocent until proven guilty in a court of law.
