PRESS RELEASE – UPDATE

On April 3, 2016 the New York State Police – Bureau of Criminal Investigation and Uniform Troopers at the Kingston Barracks investigated a 2 car fatal motor vehicle accident on Route 209 in the Town of Marbletown.

An extensive investigation into the collision by the New York State Police BCI at Kingston, the Troop F Collision Reconstruction Unit, and the Ulster County District Attorney’s Office resulted in a Grand Jury indictment of SHANNON J. PENNY, age 40, from Accord, NY for Vehicular Manslaughter in the Second Degree and Vehicular Assault in the First Degree, both felonies, Criminal Possession of a Controlled Substance in the Seventh Degree, a misdemeanor, and Unlawful Possession of Marijuana, a violation.

The investigation determined that PENNY was operating his 2000 Toyota Corolla northbound on State Route 209 in the Town of Marbletown when he drove into the southbound lane of the roadway and struck a vehicle head on being operated by FRANK WARREN age 81. LEANNE WARREN, age 78, the passenger in the vehicle, and wife of FRANK WARREN, succumbed to her injuries sustained in the collision at the Kingston Hospital.  FRANK WARREN sustained serious physical injuries as a result of the collision and is still recovering.  Toxicology results obtained from a blood sample from Mr. PENNY showed that at the time of the collision he was under the influence of Marijuana and prescription medication.

The Ulster County District Attorney’s Office presented the case to the Ulster County Grand Jury who indicted PENNY for the above listed crimes. Mr. PENNY was arraigned in Ulster County Court before the Honorable DONALD WILLIAMS and released pending a bail hearing scheduled for Thursday October 13, 2016 at 9:30 AM, at the request of the Ulster County District Attorney’s Office.

Assisting the State Police at the scene of the collision were the Ulster County Sheriff’s Office, Town of Hurley Fire Department, Town of Marbletown Fire Department and Rescue Squad, Spring Lake Fire Department and Mobile Life Paramedics.
