The New York State Police in Middletown are investigating a Fatal Motor Vehicle Accident involving a pedestrian that was struck by a motor vehicle E/B on Interstate 84 in the Town of Wawayanda.

On August 20, 2016, at approximately 8:09 PM, Troopers from SP Middletown responded to a reported MVA E/B on Interstate 84, just west of Exit 3E in the Town of Wawayanda.  A vehicle was traveling E/B in the right lane of I-84 when pedestrian, NICHOLAS BARBA, 35 years old from Bronx, N.Y. entered the roadway from the north shoulder and was subsequently struck by the passenger vehicle.  BARBA was transported from the scene and was ultimately pronounced deceased at Orange Regional Medical Center.

The investigation revealed that BARBA’s vehicle was disabled on the south shoulder of I-84.  While waiting for the tow truck to arrive, BARBA was throwing a baseball around with his son and the ball errantly went across the roadway and into the median.  As BARBA was retrieving the ball from the median and attempting to cross back over I-84 E/B, he was struck by a vehicle in the right lane.  The vehicle in question stopped at the scene and no charges are expected against the driver at this time.
