Cortlandt man charged with Aggravated Driving While Intoxicated under Leandra’s Law

Cortlandt, New York – On August 22, 2015, New York State Police from the Cortlandt barracks arrested Javier J. Erraez-Patino, 33 years old, of Cortlandt, New York, for Aggravated Driving While Intoxicated under Leandra’s Law, a Class E Felony.

Subsequent to a lawful vehicle and traffic stop conducted on East Main Street in Cortlandt, Erraez-Patino was found to be intoxicated.   Erraez-Patino was charged with Aggravated DWI under Leandra’s Law due to the fact that his one-year-old son was in the vehicle at the time of the stop.

Erraez-Patino provided a positive breath sample that yielded a Blood Alcohol Content
of .08%.  He was arraigned at the Town of Yorktown Court and remanded to Westchester County Jail on $1,000 bail. The defendant was due to appear in the Town of Cortlandt Court on August 24, 2015.
