Two Dutchess County Residents Charged with Felonies in Separate Incidents


Pleasant Valley

On March 24, 2018, at 9:51 pm David M. Leroy (5/20/90) of Hyde Park, NY was stopped for a traffic infraction on West Rd in the Town of Pleasant Valley. An investigation revealed that he was intoxicated and that he had a suspended / conditional license.  A check revealed he was operating out of those conditions and thus suspended for a DWI related offense.
Leroy was charged with DWI & BAC.08% or more both misdemeanors, Aggravated Unlicensed Operation of a Motor Vehicle 1st a felony, as well as a traffic infraction.  The AUO charge was a felony since his license was suspended for a DWI related conviction and he was intoxicated while operating the vehicle.   He was released to appear in the Town of Pleasant Valley Court on April 19, 2018, at 5:30 pm.

LaGrange

At 5:53 pm on March 25, 2018, members of the Dutchess County Sheriff’s Office responded to the scene of a one-car rollover property damage auto crash on New Hackensack Rd (Rte 376) at the intersection with Walker Rd in the Town of LaGrange.

An investigation revealed that the operator Johnny J. Symes (3/2/66) of East Fishkill, NY was operating a 2003 Honda southbound and went off the east side of the roadway striking an embankment and overturning.  Neither Symes nor his eight-year-old passenger was injured in the crash.

Symes was subsequently arrested and charged with DWI, BAC .08% or more, Aggravated DWI (Leandra’s Law) and Aggravated Unlicensed Operation of a Motor Vehicle 1st all felonies as well as Operating a motor vehicle without a Court Ordered Ignition Interlock Device a misdemeanor, as well as a traffic infraction.

The charges were felonies due to Symes having a prior DWI related conviction within the prior ten years, which was August 2017 in the Town of Poughkeepsie.  Having a child less than sixteen years of age in the vehicle while he was in an intoxicated condition and because his license was revoked for a DWI related conviction and he was intoxicated while operating the vehicle.

Johnny Symes was arraigned in the Town of LaGrange Court where he was remanded to the Dutchess County Jail to appear on March 27, 2018 at 4pm.
