Westchester County trio arrested for heroin, suboxone, and marijuana possession

Bethlehem, NY – On November 19, 2016, at approximately 9:36 a.m., State Police stopped a vehicle on I-87 for a speeding violation. The driver of the vehicle, James D. Tobin, 27, of Montrose, and his passengers, Thomas Johnston, 48, of Valhalla, NY, and Taniah D. Cousins, 21, of Mount Vernon, NY, were found to be in possession of heroin, Suboxone* film strips, and marijuana. All 3 were taken into custody, transported, and processed at SP Albany.
Tobin was subsequently charged with:
- Criminal Possession of a Controlled Substance in the 5th; a Class D Felony
- Criminal Possession of a Controlled Substance in the 7th Degree; a Class A Misdemeanor
- Tampering With Physical Evidence; a Class E Felony
- Controlled Substance Not in Original Container; Public Health Law Violation
- Unlawful Possession of Marijuana; a Violation
- Speeding Vehicle and Traffic Violation
He was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail in lieu of $50,000 cash bail or bond.
Johnston was subsequently charged with:
- Criminal Possession of a Controlled Substance in the 5th; a Class D Felony
- Criminal Possession of a Controlled Substance in the 7th Degree; a Class A Misdemeanor
- Tampering With Physical Evidence; a Class E Felony
- Controlled Substance Not in Original Container; Public Health Law Violation
He was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail without bail.
Cousins was subsequently charged with:
- Criminal Possession of a Controlled Substance in the 5th; a Class D Felony
- Criminal Possession of a Controlled Substance in the 7th Degree; a Class A Misdemeanor
- Tampering With Physical Evidence; a Class E Felony
- Controlled Substance Not in Original Container; Public Health Law Violation
She was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail in lieu of $10,000 cash bail or bond.
*Suboxone is used to treat opiate addiction, Schedule III Controlled Substance
