At approximately 12:55 p.m., Troopers were dispatched by Dutchess County 911 to a Stanley Lane residence for a subject who was reported to be acting erratically.  Upon their arrival, Gutierrez retreated to his back yard and set a television doused in gasoline on fire.  He then brandished a machete and menaced the Troopers with the weapon.  Gutierrez was taken into custody without incident and transported to the Wappinger barracks for arrest processing.

Gutierrez was arraigned in the Village of Wappingers Falls court before Justice Raymond Chase and remanded to the Dutchess County Jail in lieu of $20,000 cash bail or $40,000 bond.  He is due to return to the Town of Wappinger Court on October 4, 2016.
