Marlborough woman arrested for Criminal Negligent Homicide

07/10/16 – The New York State Police, Highland BCI announce the arrest of 25 year old Kayla M. Pagan, of Marlboro, NY, for Criminally Negligent Homicide (a class E felony).

On 07/08/16, the New York State Police – Highland BCI responded to assist the Marlborough Police Department with an investigation into the drowning death of a 10 month old female infant that occurred at approximately 7:34 PM on 07/08/16. With assistance from the State Police Troop “F” Forensic Identification Unit, the Town of Marlborough Police Department and the Ulster County District Attorney’s Office, the investigation revealed that Kayla M. Pagan intended to give her infant a bath, but knowingly left the bathroom and baby unsupervised in the bathtub for an unreasonable amount of time while the bathtub continued to fill with water which ultimately caused the baby to drown.  The father of the infant arrived at the residence from work and located the infant still in the bathtub and attempted CPR.  The infant was transported by Mobil Life to St. Luke’s Hosptial in Newburgh where she was pronounced deceased. Pagan was arrested by State Police – Highland BCI and processed for 1 count of Criminally Negligent Homicide.

Pagan was arraigned before Judge Kraiza in the Town of Marlborough Court on 07/09/16 and subsequently remanded to Ulster County Jail in lieu of $100,000 cash / $200,000 bond.  Pagan is scheduled to return to Town of Marlborough Court on 7/12/2016 at 4:00 PM.
