Stanford, New York – On December 20, 2015, New York State Police from the Poughkeepsie barracks charged 46-year-old Albert C. Wagner Jr. of Stanford, New York, with Aggravated Driving While Intoxicated, a Class E Felony.

Troopers stopped the vehicle Wagner was operating on State Route 82 for speeding.  While interviewing the defendant, Troopers observed clues that indicated he was under the influence of alcohol at the time of the stop.

Wagner was charged with felony DWI when a criminal history revealed a previous DWI related conviction from October of 2012.

Wagner provided a positive breath sample that revealed a Blood Alcohol Content
of .29%, more than three times the legal limit of intoxication.  He was issued traffic tickets directing him to appear before the Town of Stanford Court on January 6, 2016 at 6:00 p.m.
