Two Port Ewen men arrested for forcing special needs victim to engage in sex

The New York State Police at Highland in conjunction with the New York State Police at Rhinebeck and the Ulster County District Attorney’s Office announce the arrests of Daryl Vandemark, 42 and his roommate John Kindberg, 69 of Schyver St in Port Ewen, NY. Vandermark was charged with two counts each of Criminal Sex Act 1st and 2nd, Endangering the welfare of an incompetent or physically disabled person in the 1st, all felonies and the misdemeanor of Criminal Possession of a Weapon 4th.  Kindberg was charged with Endangering the welfare of an incompetent or physically disabled person in the first degree.

The charges stem from an investigation which revealed that on 7/12/15 the two defendants had a mentally handicapped young male visiting their residence on Schyver St in Port Ewen. Vandermark is alleged to have had forcible sex with the male victim on more than one occasion on that date while Kindberg watched but did not participate. The victim was threatened with a knife during this encounter and was told not to contact authorities.

Both parties were arraigned before arraigned before Town Justice Elizabeth Shanley Vandermark was committed to the Ulster County Jail on 50,000 cash bail or  a 100,000 bond.  Kindberg was remanded on 5,000 cash bail or a 10,000 bond.
