East Fishkill Police Department – Domestic dispute

On September 13th 2018 at 11:58 PM, Officers were dispatched to a residence on Palen Road for the report of a Husband and Wife verbal domestic dispute. The responding Officers were advised that there was an active order of protection in place between the two parties and the male half of the dispute had fled the area in a Red SUV. While en route to the area, Police Officer Sean Phillips observed the suspect vehicle on Route 52 traveling eastbound. Officer Phillips was in a marked Police Vehicle and activated his emergency lights and sirens, attempting to pull the subject over. The vehicle’s operator failed to comply and in doing so, intentionally struck 2 marked Town of East Fishkill Police vehicles. Officer Phillips and Sergeant Paul Gaston were eventually able to get the vehicle to stop on Interstate 84 and the on ramp to the Taconic State Parkway. At that time, Officers encountered Donald L. Curry, age 51, of Mohegan Lake. It was discovered that there was in fact an active order of protection in place prohibiting Mr. Curry from contacting or going to the home of the protected party. Additionally, Mr. Curry appeared intoxicated at the time of the stop. Mr. Curry was taken into custody and charged with 2 counts of Attempted Assault 2nd degree, 2 counts of Criminal Mischief 2nd degree, 2 counts of Reckless Endangerment 2nd, Reckless Driving, Criminal Contempt in the 2nd degree, Aggravated Driving While Intoxicated and numerous Vehicle and Traffic Law infractions. Mr. Curry was processed and later arraigned in the Town of East Fishkill Court by the Honorable Judge Frederick Romig where he was remanded to Dutchess County Jail on $50,000.00 cash bail or $100,000.00 bond, pending a future court date. Officers on scene were assisted by members of the New York State Police and Dutchess County Sheriff’s Office.
