Carmel man charged with marihuana possession and DWI following traffic stop

East Fishkill, New York – On February 27, 2017, New York State Police from the Stormville barracks arrested James A. Klett, 28 years old, of Carmel, New York, for Criminal Possession of Marihuana 2nd Degree, a Class D Felony, Criminal Possession of a Controlled Substance in the 7th Degree, a Class A Misdemeanor, and Driving While Intoxicated, a Misdemeanor.

Klett was stopped by police on the Taconic State Parkway for speeding.  While speaking with the defendant, the Trooper observed a strong odor of marihuana and alcohol emanating from the vehicle.  The arresting officer administered Standardized Field Sobriety Tests to Klett that revealed he was intoxicated at the time of the traffic stop.  An investigation revealed that Klett possessed concentrated cannabis and over 495 grams of marihuana.

Klett provided a positive breath sample that revealed a Blood Alcohol Concentration of .08%.  The defendant was arraigned in the Town of East Fishkill Court and remanded to the Dutchess County Jail in lieu of $5000 cash bail or $10,000 bond.  Klett is due to return to East Fishkill Court on March 3, 2017.
